1. Scope and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Eagle Eye Securities website, mobile applications, drone surveillance services, cloud platform, APIs, and any related products or services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Definitions

"User," "You" – Any individual or entity accessing the Services.
"Services" – All offerings by Eagle Eye Securities, including drone surveillance, live monitoring, recorded footage, analytics, and reporting.
"Content" – Text, images, video, data, or other materials generated or transmitted via the Services.
"Platform" – The web and mobile interface for accessing Services.
"Client" – A paying customer with an active subscription or contract.

3. User Obligations & Conduct

You agree to:

Use the Services only for lawful purposes and in compliance with all applicable federal, state, and local laws, including FAA drone regulations (14 CFR Part 107), privacy laws, and trespass statutes.
Not use drones or Services to record in areas with a reasonable expectation of privacy (e.g., inside homes, restrooms) without consent.
Not interfere with, disrupt, or attempt to gain unauthorized access to the Services.
Not reverse-engineer, decompile, or extract source code from the Platform.

Prohibited Uses Include:

Surveillance of protected classes without legal basis
Recording audio without consent where required by law
Using footage for extortion, harassment, or defamation
Operating drones in restricted airspace

4. Account, Registration & Security

You must register with accurate information to access certain Services.
You are responsible for maintaining the confidentiality of your login credentials.
Notify us immediately at support@eagleeyesecurities.com of any unauthorized use.
We may suspend or terminate accounts for violation of these Terms.

5. Fees, Payments & Refunds

Paid Services are billed in advance on a monthly or annual basis.
All fees are non-refundable, except as required by law or stated in a separate contract.
We may change pricing with 30 days' notice via email or in-app notification. Continued use after changes constitutes acceptance.
Late payments may incur a 1.5% monthly interest charge.

6. Intellectual Property Rights

Eagle Eye Securities owns or licenses all rights to the Platform, drone software, analytics engines, and branding. You are granted a limited, non-transferable, revocable license to use the Services for your internal security needs.

Client Content (your footage, reports) remains your property, but you grant us a worldwide, royalty-free license to:

Process, store, and transmit it
Generate analytics and improve Services
Comply with legal requests

You may not resell, sublicense, or redistribute Services.

7. Third-Party Services & Links

The Services may integrate with third-party tools (e.g., cloud storage, maps).
We are not responsible for third-party services. Use at your own risk.
Links to external sites are provided for convenience; we do not endorse them.

8. Disclaimers & "As Is" Service

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of drone footage or analytics

Drone operations depend on weather, GPS, and line-of-sight. We do not guarantee uninterrupted service or 100% detection.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Eagle Eye Securities shall not be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, data, or business).
Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Termination & Suspension

You may terminate your account at any time via the Platform or by emailing support@eagleeyesecurities.com.
We may suspend or terminate your access immediately if you:
- Violate these Terms
- Engage in illegal surveillance
- Fail to pay fees

Upon termination, your data may be deleted after 30 days.

11. Indemnification

You agree to indemnify and hold harmless Eagle Eye Securities, its officers, and agents from any claims arising from:

Your use of the Services
Violation of laws or third-party rights
Misuse of drone footage

12. Governing Law & Dispute Resolution

Governed by the laws of the State of California, excluding conflict of law principles.
Disputes shall be resolved in the state or federal courts in Sacramento, California.
No class actions. All claims must be brought individually.

13. Changes to Terms

We may update these Terms at any time. Changes will be posted here with the updated "Last Updated" date. Continued use after changes constitutes acceptance.
